Article 1 (Application)
These Terms set forth the handling of "DearSt Points" (the "Points") granted by NEXST Inc. (the "Company") to users in connection with "DearSt! RHYTHM STAGE".
Matters not provided for in these Terms regarding the use of the Points shall be governed by the "DearSt! RHYTHM STAGE" Terms of Use and other conditions separately specified by the Company within the Service or on the Company's website.
Article 2 (Definition and Nature of the Points)
- The Points are points granted by the Company to users who satisfy conditions prescribed by the Company within the Service.
- The Points are granted free of charge and cannot be purchased with money or other consideration.
- The Points are not legal tender or equivalents thereof, and cannot be exchanged for cash, refunded, or reimbursed.
- The monetary value or exchange rate per Point is not guaranteed.
- The number of Points required for exchange of rewards or other use of the Points shall be separately determined by the Company.
Article 3 (Granting of the Points)
- The Company may grant the Points to users who satisfy conditions separately specified by the Company, such as gameplay, task completion, and campaign participation.
- The number granted, timing of grant, conditions of grant, and other details of the Points shall be separately specified by the Company within the Service or on the Company's website.
- The Company may, without prior notice, cancel or invalidate any Points that the Company determines to have been obtained by fraudulent means.
Article 4 (Use of the Points)
- Users may use Points held by them for exchanges for rewards specified by the Company within the Service or on the Company's website, entries into prize drawings, determination of conditions related to free-grant campaigns conducted by the Company or its partners, and other uses prescribed by the Company.
- Where separately specified by the Company, users may lock all or part of their Points. The handling of locked Points, whether and how locks may be released, and other conditions shall be separately determined by the Company.
- The number of Points required for exchange of rewards, entry into prize drawings, or locking under the preceding item, terms of use, availability, entry conditions, and other details shall be separately determined by the Company.
- After the Points have been used, users may not request cancellation, return, or modification of the Points except where permitted by laws or regulations.
- The content, specifications, timing of provision, and other conditions of rewards shall be governed by the terms separately specified by the Company or by the provider of such reward.
Article 5 (Use of External Services)
- In connection with the receipt of rewards or other use of the Points, the use of external services provided by third parties other than the Company may be required.
- When using external services, users shall comply with the terms of use and other conditions of such external services.
- Except in cases of willful misconduct or gross negligence on the part of the Company, the Company shall not be liable for any troubles arising in connection with the use of external services.
Article 6 (Expiration and Invalidation)
- The Points shall be valid for 180 days from the date each Point is granted.
- Points that have passed the expiration date will be automatically invalidated and can no longer be used.
- Notwithstanding the preceding two items, if the Service is terminated or a user's account is deleted, all Points held by such user shall be invalidated.
- Invalidated Points shall not be restored for any reason.
Article 7 (Prohibited Acts)
Users shall not engage in the following acts with respect to the Points:
- Transfer, lending, sale, sharing, or other similar acts to third parties;
- Requesting exchange for cash, refund, or similar acts;
- Acquisition, use, or disposal by fraudulent means;
- Other acts that the Company determines to be inappropriate.
Article 8 (Disclaimer)
- The Company shall not be liable, to the extent permitted by law, for any indirect, incidental, or special damages incurred by users in connection with the granting, use, invalidation, or unavailability of the Points.
- Where a user uses the Service as a consumer, the provisions of this Article shall apply only to the extent not in conflict with applicable consumer protection laws.
Article 9 (Changes to these Terms)
- The Company may change the content of these Terms as necessary.
- If the Company changes these Terms, the Company will publish the changed Terms within the Service, on the official website, or by other methods prescribed by the Company, and the changes shall take effect from the time of such publication or from another effective date separately specified by the Company.
- Where the content of a change materially affects the rights and obligations of users, or where user consent is otherwise required by laws or regulations, the Company will obtain such consent by methods prescribed by the Company.
